Restrictive Covenant and Injunctive Relief Defense

R. R. Donnelley & Sons Company v. Grantmail Direct Ltd., No. 1:25-cv-11063 (N.D. Ill.)

Lead counsel for defendant sued by a multibillion-dollar marketing and communications company over supply agreement's non-solicitation, non-compete, and confidentiality covenants. After plaintiff sought a temporary restraining order, Peter resolved the matter before the Court ruled, ending the threat of related litigation in other jurisdictions.

Product Liability and Insurance Subrogation Defense

Liberty Mutual Insurance Co. v. XYG North America, No. 1:26-cv-02362 (N.D. Ill.)

Co-counsel for defendant glass manufacturer in an insurance-subrogation action alleging strict product liability, breach of implied warranty, and negligence in connection with insulated glass units installed in a Chicago high-rise.

Breach of Promissory Note

Caugherty v. Sylvester, No. 2025 L 011983 (Cir. Ct. Cook Cty., Law Div.)

Lead counsel for the plaintiffs in a Cook County commercial lawsuit to enforce a written promissory note. Work includes briefing motion for summary judgment, including damages, fees, and costs.

Trade Secret Misappropriation

Mainstream Swimsuits, Inc. et al. v. Amerex Group, LLC, No. 1:25-cv-00545 (D. Del.)

Lead counsel for plaintiffs in a seven-count action for trade secret misappropriation, design-patent infringement, and copyright infringement after a competitor hired plaintiffs’ former division president. Case settled during document discovery.

Design Patent and Trademark Infringement

Global Trademarks, Inc. v. Swimsuits for All, LLC et al., No. 1:24-cv-00611 (S.D. Ind.)

Lead counsel for a national swimwear manufacturer asserting design-patent infringement, federal trademark infringement, and unfair-competition claims against a group of affiliated e-commerce retailers. Secured leave to amend to add newly identified accused products and drove the matter through the substantial completion of document discovery.

Executive Severance Negotiation: Invalid Company Disclosures

Represented a senior executive in pre-litigation severance negotiations, finding a defect in the employer’s release that undid its waiver. Case resulted in a substantially improved exit package, without litigation.

Employment Agreement Negotiation: Restrictive Covenants

Represented a C-suite executive in negotiating the terms of employment with a publicly traded employer. Secured an additional cash sign-on bonus, increased equity compensation, reduced the non-compete period by 75%, and narrowed overbroad non-solicitation provisions, without any litigation or bad blood.

Executive Severance Negotiation: Race and Age Discrimination

Represented a long-tenured executive in pre-litigation negotiations over race and age discrimination claims. Built a factual record that the employer’s stated reason for the termination was pretextual, and negotiated a substantial increase to the initial severance offer. Resulted in a favorable settlement, without litigation.
